Terms and Conditions.

1) The terms and conditions shown on this page, together with the documents and other webpages referred to on it (collectively, the “Terms”) govern:
     a. your purchase and our supply of any of the goods (“Products”) listed on our website www.sleepid.co.uk (“our Site”) from time to time; and
     b. your access and use of our Site, (collectively, the “Services”)

2) Information about us – We are Adjustamatic Beds Limited a registered Company in England and Wales under Company Number 1617452. These are our terms and conditions of sale which apply to your purchase and our supply of any of the goods (“Products”) listed on our website www.sleepid.co.uk (“our Site”) and your access and use of our Site, (collectively, the “Services”). Our registered office is Colomendy Industrial Estate, Rhyl Road, Denbigh, Denbighshire, LL16 5TS. Telephone: 01745 811 200.

3) The Terms create a legally binding agreement between you and us that governs your purchase of any Products from us via the Site (your “Order”). By clicking to confirm during the checkout process, you agree that you accept these Terms and promise to us that you have the right, authority, and capacity to enter into these Terms. If you use the Site, but don’t make an Order, you accept these Terms (as they relate to your use of the Site) by accessing or using the Site.

4) Our acceptance of an Order occurs when we send you a confirmation email and give you an order number. It is at this point that a contract between you and us will come into existence – as noted above, this contract is governed and conditioned by these Terms.

5) Our prices on our UK website are in GBP and include all taxes (for example, our prices include VAT at the rate that is in force on the date you make a payment). The price that you will actually pay in respect of any Order will be the amount shown to you at the checkout page. We reserve the right to change the prices shown for the Products at any time.

6) As you are purchasing the Products online you have a legal right to change your mind within fourteen days from delivery of the Products and receive a refund. For example, the Consumer Contracts Regulations 2013 do not entitle you to be reimbursed for the costs of returning products.

7) Acknowledgement and acceptance of your order – Your order, once made through our website, constitutes our acceptance of your order and together with payment of your deposit, and these terms and conditions of sale, form a legally binding contract between you and us. We will confirm your order via email. We are under a legal duty to supply goods that are in conformity with our contract with you. All our products are handmade to order and we pride ourselves in making high quality goods for you.

8) Product specification – Any photographs, swatches, sizes and/or product description, and any illustrations contained in our brochures or on our website are produced to provide you with an approximate idea of the Goods they describe and/ or are representative of the finished product. Goods are purchased and supplied, on the understanding that there may be slight variations in dye, shade, grain and natural marks, particularly with natural products such as wood and leather.

9) Delivery information – Standard UK delivery of all SleepID® Products is included in the prices you see on the Site – there are no hidden costs added at checkout. We will contact you to confirm a suitable delivery date and where applicable take payment of any outstanding balance. Alternatively, we can provide you with our bank account details for you to make direct payment into our account up to 5 working days before delivery is due. Payments made by cheque must clear in good time before delivery. Please note that all orders must be paid in full prior to delivery and goods will remain the property of Adjustamatic Beds Limited until full payment has been made. On the day of delivery, please ensure that the delivery team can gain easy access to the room that the mattress or furniture is going into and the place for your new product is clear. Our delivery team will fully install your product and demonstrate how to use them. To make sure you are completely satisfied with your product, the delivery team will ask you to sign for receipt after it has been installed. Please note, we shall not be liable for any delay in delivery of the goods that is caused due to circumstances beyond our reasonable control. If you do not take delivery of the goods after our delivery team has confirmed a delivery date, then, except where such failure or delay is caused by circumstances beyond our control, we may charge for all related costs and expenses for the non-delivery i.e. transportation, the cost of which is £120.00 inclusive of VAT.

10) Disposal of old products – We are able to dispose of your old products with ease and do so on a like for like basis. We recycle old products wherever possible through a licenced recycling company. The cost of removal is £75.00 plus VAT for a Bed or Chair and £35.00 plus VAT for a mattress. Please note that we are unable to return any removed items.

11) Orders on hold – On occasion our customers may require us to place their order on hold pending manufacture. An initial deposit is required to be paid. Please note that in these circumstances, the price quoted at the time of the order will be honoured for six months. After this time, if prices have increased due to circumstances beyond our control, e.g. the cost of materials, we will duly notify customers of any reasonable fluctuation in the price payable for the goods.

12) Customer Care – We have over fifty years’ experience of customer support. Our expertise is supported by a team of fully trained Customer Support Advisors and a Service Manager who have the skills to resolve all issues. To provide you with the very best customer service, we may record calls for training or monitoring purposes. We are always happy to help you with any questions you may have regarding your experience, product information, or information on returns and exchanges. To provide customers with peace of mind and to demonstrate our commitment to responsible retailing, Adjustamatic Beds Limited is a registered full member of The Furniture Ombudsman. The Furniture Ombudsman raises standards and is approved by the government to provide alternative dispute resolution services. We follow their Code of Practice which provides our customers with additional protection if they are not satisfied. 13) Your guarantee –  The SleepID® Mattress is guaranteed for two years from the date of delivery. The guarantee starts from the date of delivery and provides cover against manufacturing defects for two years on the upholstery, foam, fillings, control electronics, cables and motors. The guarantee will be given to you at the time of delivery. It is important that you register this guarantee within two months of delivery.
 
14) Right to cancel – We want you to be delighted with your purchase but if you are not, you can return your product under the Consumer Contracts Regulations. Your right to cancel starts from the moment you place your order and ends 14 days after you take delivery of the goods. Where delivery of goods is split across different dates, this will be 14 days after the final delivery date. 

This means that if you change your mind or decide for any reason that you do not want to receive or keep goods, you can notify us of your decision to cancel and receive a refund. To cancel the contract, you just need to let us know. The easiest way to do this is to contact our Customer Support team on: 0800 689 6887. You can also e-mail us at support@adjustamatic.co.uk or complete and return the cancellation form below. Advice about your legal right to cancel the contract is available from your local Citizens’ Advice Bureau or Trading Standards office.

15) The goods must be returned complete, in perfect condition, unused and with all tags and labels attached (unless faulty or incorrectly described). For hygiene reasons, we can only accept returns of Mattresses if they have not been used. Please contact our Customer Support team for further assistance. Please note returns are not possible on any goods that are bespoke, as these items are personalised for you. (unless faulty or incorrectly described).

16) We will charge a collection cost for the goods we collect in the event you cancel your order. The cost relating to furniture collection, including dismantling and transportation costs is £177.00 (inc. VAT). The collection cost for mattresses is £49.00 (inc. VAT). The collection cost for portable equipment is £23.00 (inc. VAT) Please note the goods will remain your responsibility until we collect. You must ensure that on the day of collection the access to the goods is clear and free from obstruction. If the access is not clear and free from obstruction, then we will not be able to collect the goods.

17) Refunds – We will refund you the price you paid for the goods, deducting any applicable collection/non-delivery/usage cost which we will offset and retain. Please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling the goods more than was necessary, or by using them in a way which would not be permitted if you were assessing the goods in a shop. If applicable, our Customer Support team will duly advise you of any proposed cost to be offset and to be retained from the total refund.

18) Normally refunds are processed to you in 14 working days from when we have received return of the goods. We will usually refund any money received from you using the same method originally used by you to pay for the goods.

19) General – Our agreement with you is based upon English Law. All the Products are made to comply with applicable UK laws and regulations. The laws applicable to this agreement are the laws of England and Wales. Please read these terms and conditions carefully, which are also applicable if your order is made under our corresponding company Niagara Therapy (UK) Limited which is also registered in England and Wales at the above address under Company Number 857402.

  • This Promotion is only open to individuals aged 18 years or over on date of entry.

  • By entering this Promotion, You (also referred to in these terms as “Entrant” or “Your”) agree to be fully bound by these Terms & Conditions, and You represent and warrant that You meet the eligibility requirements.

  • Promotion Period.  The Promotion begins at 10:00am on 26/02/21 and closes at 11:59pm on 8/4/21 (“Promotion Period”). Any entry received after the closing date and time of the Promotion Period will be disqualified. Proof of sending or transmission is not proof of receipt of entry to the Promotion.

  • Entrants must have access to the internet, a valid email address, and an active Facebook account.

  • Entry is free, and no purchase is necessary to enter this Promotion. A maximum of one (1) entry per person is allowed. A maximum of one (1) prize may be won per household.

  • Email Requirement. There is no email requirement for this Promotion.

  • ‘Comment’ or ‘Like’ Requirement. “Liking” or commenting on any other post on the SleepID Facebook page during the Promotion Period will not count as entry into this Promotion.  Entrants must not attempt to or otherwise enter the Promotion using multiple accounts or entries which are automatically generated by computer, any such entries will be disqualified from participation in the Promotion.

  • Entrants must not publish other postings.

  • Entrants must not attempt to enter the Promotion using multiple accounts or multiple entries across different social media channels. Entrants found to be doing so will be ineligible to participate in the Promotion. It is the responsibility of entrants to ensure they comply with Facebook’s usage and other applicable rules.

  • The Promoter accepts no responsibility for entries that are lost or otherwise not successfully completed due to a technical fault, malfunction, systems, computer hardware or software issues or network or server failures of any kind.

  • No entries from agents, third parties or those automatically generated by computer or any software will be accepted. Incomplete or corrupted entries will not be accepted. Entries are valid only if they comply with all the requirements stated in these Terms and Conditions.
    The Promoter reserves all rights to disqualify You if Your conduct is contrary to the spirit or intention of the Competition.

  • There will be one (1) winner selected each week, six (6) in total.

  • Prize Description. The winner will receive the following prize depending on the week in which they entered:

  • The promoter reserves the right to replace the prize item with alternative items of equal value if circumstances beyond the Promoter’s control makes it necessary to do so.

  • The Prize is non-negotiable, non-transferable and cannot be exchanged for cash or other value nor can it be redeemed by the winner for any other prize. To the extent permitted by law, the Prize is awarded “as is” with no warranty or guarantee, either express or implied.  Your statutory rights are not affected.

  • All valid entries submitted during the Promotion Period in accordance with these terms and conditions will be put into a draw, and one (1) single winner will be randomly selected on the Monday following each week by the Promoter:

    • Week 1 – Start: 26/02/21, entries close: 04/03/21, winner announced 08/03/21

    • Week 2 – Start: 05/03/21, entries close: 11/03/21, winner announced 15/03/21

  • In all matters, the random selection of the Winner made by the Promoter shall be final and no correspondence or discussion shall be entered into.

  • Winner Notification.  The Promoter will make all reasonable efforts to contact the Winner within one week of the winner announcement via Facebook message. The Promoter reserves the right to ask for proof of identity, and postal address of the Winner.

  • The Winner is required to respond to the Facebook message within forty-eight (48) hours in order to provide proof of identity and postal address details and claim the Prize. Failure to do so will result in the Prize being forfeited by the Winner and the Promoter reserves the right to select another winner using the same process referred to above in these terms and conditions.

  • Upon receipt of the aforementioned information the Prize will be delivered to the Winner’s postal address via courier within fourteen working days of the Winner successfully claiming the Prize.  The Prize may not be claimed by a third party on behalf of the Winner.

  • The Promoter accepts no responsibility for delayed or failed delivery of the Prize due to provision of incorrect postal address or other contact details provided by entrants. Any Prize that is returned undelivered will be assumed unwanted and the Promoter reserves the right to select an alternative winner to receive the Prize using the same winner selection process referred to above in these terms and conditions.

  • By entering this Promotion, entrants will be deemed to have accepted and agreed to be bound by these terms and conditions.

  • Losing entries will not receive any notification.

  • By entering, all entrants grant the Promoter, and their licensees, successors and assigns, the assignable, perpetual, worldwide, irrevocable, non-exclusive license to publish, reproduce, prepare derivative works of, distribute, display, exhibit, transmit, broadcast, televise, digitize, otherwise use, and permit others to use their entry for this Promotion, including the names and likenesses of any persons embodied therein, in any manner, form, or format now or hereinafter created, including on the Internet, and on Promoter social media sites, and for any purpose, including, but not limited to, advertising or promotion of the Promoter, all without further consent from, notice, or payment to the Entrant or Winner(s). The Promoter is under no obligation to make use of the rights granted herein.

  • Nothing in these terms and conditions shall exclude the liability of the Promoter for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence or any other liability which may not be excluded by law. The Promoter excludes all other liability to the extent permitted by law and in particular without limitation to the foregoing, the Promoter shall not be liable for any indirect, special or consequential loss nor for loss arising out of matters outside of its control nor for entries lost, delayed or undelivered, nor any liability for technical errors or communication failures in networks and/or internet access. Your statutory rights are not affected.

  • By participating, each Entrant agrees to release, indemnify, discharge and hold harmless the Promoter, and Facebook, Inc. (“Facebook”), and each of their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Promotion or any promotionally-related activity, the acceptance, possession, use or misuse of any Prize and/or Promoter’s use of the rights granted herein.

  • The Promoter reserves the right at any time to modify, discontinue (temporary or permanently) this Promotion with or without prior notice due to reasons outside its control (including in the case of anticipated, suspected or actual fraud). The decision of the Promoter in all matters under its control is final and binding.

  • The Promoter reserves the right to refuse entry or refuse to award the Prize to any person in breach of these terms and conditions.

  • This Promotion and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
